TERMS AND CONDITIONS OF ENTRY FOR THE “A TASTE OF HARMONY MAJOR PRIZE PROMOTION” (PROMOTION)

 

Information on how to enter and prize information form part of these conditions of entry (Conditions of Entry).

 

Entry into the Promotion is deemed to constitute acceptance of these Conditions of Entry.

 

Sally Tyrell trading as Blackbird PR (ABN 35 926 185 664) of 31/367 Collins Street, Melbourne (the Promoter) is responsible for conducting theA Taste of Harmony Competition(the Competition).

 

Entrants are responsible for ensuring their familiarity with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of an entitlement to enforce that restriction or of the Conditions of Entry in general.

 

All entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of an entrant’s ineligibility after the Promoter has awarded a prize. Return of the prize or payment of its equivalent value to the Promoter may be required by the Promoter in this scenario.

 

The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on each entrant. No correspondence will be entered into.

 

PROMOTION PERIOD

 

The Promotion will commence at 11:01 AEDT on 15/02/2019and conclude at 23:59 AEDT on 29/03/2019(Promotion Period).

 

WHO CAN ENTER

 

Entry in the Promotion is open to anyone aged 18 years or older, excluding:

 

management, employees, directors and contractors of the Promoter, its related entities and other agencies;

 

a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 8(a) of these Conditions of Entry; and

 

persons who have breached the terms and conditions of any prior promotion run by or on behalf of the Promoter,

 

(EligibleEntrants). The persons referred to in paragraph 8(b) of these Conditions of Entry includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.

 

HOW TO ENTER

 

To enter and be eligible to win, Entrants must, during the Promotion Period:

 

register their workplace (or team within their workplace) to take part in the “A Taste of Harmony” event (the Event) using the Register Now! button located within the email communication sent by the Promoter on 15 February 2019; or by visiting tasteofharmony.org.au/register(Promotion Website); and

 

at the time of registering (i.e. when prompted during the registration process), provide:

  • a description of a dish that represents their cultural background, or that they simply love to eat, and why they like to share it with people.

 

(Eligible Entry).

 

An Eligible Entrant will receive a limit of one (1) entry for each Registration Form completed as part of an Eligible Entry.

 

If an Eligible Entrant registers more than one (1) event on a single Registration Form, they will be eligible to more than one entry up to the number of events registered provided they submit a separate and unique entry for each event.

 

The Promoter is not responsible for any technical difficulties encountered in accessing the Promotion Website. Any costs associated with accessing the Promotion Website are the entrant’s responsibility and are dependent on the internet service provider used.

 

Incomplete, ineligible, indecipherable or incorrect entries (as determined by the Promoter in its absolute discretion) are not eligible to win.

 

Eligible Entries are deemed to be received at the time of receipt into the Promoter’s database, not time of transmission by the entrant.

 

VERIFICATION

 

If requested by the Promoter, entrants must produce, within the time stipulated by the Promoter, appropriate photo identification or other documentation required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a prize, and compliance with these Conditions of Entry.

 

If the items required by the Promoter are not received or an entrant has not verified to the satisfaction of the Promoter within the time period stipulated by the Promoter, the entry/entries submitted by the entrant will be deemed invalid.

 

A prize will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction. In the event that the entrant cannot provide suitable verification, the entrant will forfeit the right to a prize (if won) and no substitute will be offered.

 

All costs associated with or arising in connection with the receipt of a prize are the responsibility of the respective prize winner.

 

JUDGING

 

Entries will be judged at 12 noon AEST on 03/04/2019by 2 representatives of the Promoter.

 

This Competition is a game of skill only and chance plays no part in determining winners. All valid entries received during the Competition Period will be judged by the Promoter on their originality and creative merit. The information that any entrant provides will be used only for the purposes outlined in these terms and conditions. Any questions, comments or complaints about this Competition can be directed to the Promoter.

 

MAJOR PRIZE INFORMATION & CONDITIONS

 

The Major Prize includes:

 

Two direct, return starter air fares from a Jetstar Australia port to New Zealand inclusive of airfare related taxes, charges and 20kg baggage up to the value of $1000 (including GST),(unless the Major Prize winner and their nominated companion reside in New Zealand, in which instance flights will notbe included in the Major Prize);

 

four (4) nights’ 4-star accommodation for a maximum of two people valued up to $2,000 (including GST);

 

five-day car hire valued up to $500 (including GST);

 

AUD$500 spending money, awarded to the winner only as a VISA card.

 

Flights are not included in the Major Prize if the Major Prize winner resides within New Zealand. In this instance the Major Prize winner and nominated companion must make their own way to and from the accommodation at their own expensein order to participate in the Major Prize.

 

The Major Prize must be redeemed/travelled in full by 04/10/2019.

 

The travel arrangements are subject to availability at all times, including the availability of the nominated seat class for airfares, or room type with the accommodation provider.The Major Prize winner will be required to provide the Promoter with preferred travel date options when requested and travel dates will remain the discretion of the Promoter.

 

Both people travelling the Major Prize must be aged 18 years or older.

 

All aspects of the Major Prize (including travel and accommodation) are for two (2) people travelling together at all times. The prize winner and travel companions must travel on one Jetstar booking. Please note that names cannot be changed once submitted to Jetstar.

 

Nominated travelling companions are not permitted to travel without the prize winner on any flight booked using the prize.

 

All components of the Major Prize must be taken together as a single trip as described above and as booked by the Promoter. Once booked, no changes to the booking are permitted.

 

All travel is subject to availability at the time of booking. All travel is subject to Jetstar’s General Conditions of Carriage and the fare conditions quoted at the time of booking.

 

Any additional travel or land content booked, in addition to the redemption of the Prize, will be subject to standard booking conditions.

 

It is the winner’s and their travelling companions’ personal responsibility to comply with any health or government requirements and ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the winner and their travelling companion.

 

All prize travel must be booked at least 4 weeks before departure. The winner and their travelling companions will not accrue Qantas Frequent Flyer points on the prize travel and cannot use cash or Qantas Frequent Flyer points to upgrade prize travel.

 

If for any reason the Major Prize winner or nominated companion do not take an element of the Major Prize at the time stipulated by the Promoter, then that element of the Major Prize will be forfeited, and no substitute or cash be supplied in lieu of that element of the Major Prize.

 

The Major Prize winner must hold a valid credit card and present it upon check in at the accommodation establishment to cover any incidental costs or other hotel charges not covered as part of the Major Prize.

 

All costs, expenses and charges associated with or arising in connection with the Major Prize which are not expressly incorporated as part of the Major Prize are the sole responsibility of the Major Prize winner and the Promoter accepts no responsibility for such costs, expenses or charges.

 

The Major Prize does not (except as expressly stated) include the following:

 

any transport between the Major Prize winner’s residence and the departure airport (if applicable);

 

any overnight accommodation while travelling to the departure airport or destination (if applicable);

 

any other travel or accommodation;

 

any incidental hotel charges (such as mini-bar charges, telephone calls, in-house movies, food and beverages);

 

any insurance (such as travel or health cover), however the Promoter requires the Major Prize winner and their nominated travelling companion to cover themselves with full travel insurance valid for international travel (if applicable). Receipt of insurance for all persons travelling must be supplied to the Promoter prior to travel. Should the Major Prize winner and their travelling companion fail to take out travel insurance, the Promoter will require them to sign a waiver prior to travel; and

 

any other ancillary costs which may be incurred by those travelling.

 

Participation in the Major Prize is subject to such other terms and conditions as may be imposed bythose involved in providing the goods or services included in the Major Prize (Third Party Terms).

 

The Major Prize winner and nominated travelling companion participating in the Major Prize are responsible for compliance with all applicable Third Party Terms and bear all risks associated with failure to comply with any of them. They will be required to maintain an acceptable standard of behaviour while a participant in the Major Prize. The Promoter assumes no liability (and will provide no compensation) to the Major Prize winner and/or nominated travelling companion who, as a result of any failure to comply with any Third Party Terms:

 

is unable to participate in the Major Prize (or any part of it); or

 

suffers any other loss or damage.

 

As a condition of accepting the Major Prize, the Major Prize winner and companion must sign any legal documentation as and, in the form, required by the Promoter and/or Major Prize providers in their absolute discretion, including but not limited to a legal release and indemnity form.

 

The Major Prize cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If the Major Prize is obtained through any of these methods, it will not be honoured.

 

NOTIFICATION OF WINNERS

 

Prize winners will be notified by phone and via email, and will subsequently be announced on the Campaign Facebook Page (A Taste of Harmony) and the Promotion Website from 23/04/2019.

 

UNCLAIMED PRIZE (IF ANY)

 

If a prize is undeliverable (i.e. a prize winner cannot be located) by 11:00 AEST on 17/04/2018, a second winner will be chosen at 12 noon AEST on that date by a representative of the Promoter from all remaining Eligible Entries received in the Promotion in order to distribute any unclaimed prize/s.

 

 

NOTIFICATION OF NEWLY-CLASSIFIED WINNER/S (IF ANY)

 

The newly classified winner/s (if any) will be notified by phone and via email, and will subsequently be featured on the Campaign Facebook Page and the Promotion Website from 08/05/2019.

 

GENERAL

 

If more than one person attempts to claim a prize, the Promoter has sole and absolute discretion to determine which of those persons is the winner of the prize.

 

The Promoter accepts no responsibility for any variation in the value of a prize from the time of printing Promotion materials.

 

Prizes are not transferrable, exchangeable or redeemable for cash.

 

It is the responsibility of the winner and their travelling companion to enquire about local issues and conditions at destinations before travel. Jetstar makes no representation as to the safety, conditions or other issues that may exist at any destination.

 

Before you book your international flight, and before you travel, check current Government travel advisories.

 

If the Promoter is unable to provide a prize winner with the nominated prize (or prize component), the Promoter reserves the right to supply an alternative prize (or prize component) of similar monetary value to the nominated prize, subject to any directions given by relevant state and/or territory regulatory authorities.

 

The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available at all times during the Promotion Period.

 

If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, network failure, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to state/territory law, including cancelling, terminating, modifying or suspending the Promotion.

 

Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry or draw mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.

 

The:

 

(a)  Promoter, the Promoter’s related entities, and all agencies associated with the Promotion, including Jetstar; and

 

(b)the employees, agents, directors and contractors of all entities,

 

shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of a prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).

 

The Promoter accepts no responsibility whatsoever for any tax liabilities that may arise from winning or receiving the benefit of a prize and independent financial advice should be sought by the respective winner.

 

Prize winners must, at the Promoter’s request, participate in any Promotion activity (such as publicity and photography) relating to winning a prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material.

 

  

PERSONAL INFORMATION AND CONSENTS

 

Immediately upon submission by an entrant, any entry becomes the sole property of the Promoter.

 

All information entrants provide (Personal Information) will be used by the Promoter for the purpose of administering this Promotion and contacting and verifying the winners.

 

Should an entrant’s Personal Information change during the Promotion Period, it is the entrant’s responsibility to notify the Promoter by contacting Sally Tyrell from Blackbird PR at sally@blackbirdpr.com.au

 

The Promoter may disclose Entrants’ Personal Information to its contractors and agents to assist in conducting this Promotion and as required, to Australian regulatory authorities.

Each entrant consents to the Promoter and/or Scanlon Foundation using their name, image and entry (including their submitted photo and caption) in the event that they are a winning entrant in any media (including social media and the Scanlon Foundation website) in perpetuity without remuneration for the purpose of promoting the Taste of Harmony campaign. Each entrant unconditionally, perpetually and irrevocably waives any moral rights (as defined in the Copyright Act 1968 (Cth)) that they have in the entry or content or other intellectual property created as a result of this Competition.

OPTING-IN TO HEAR FROM THE PROMOTER

By registering an event and submitting an Eligible Entry in the Promotion, Entrants understand that the Personal Information provided may be entered into a database and may be used by the Promoter, the Promoter’s related entities, and agencies engaged by the Promoter, for the Promoter’s current and future promotional and marketing purposes without further reference or compensation to the entrant.

Entrants may request to update or correct their Personal Information held by the Promoter and/or may request that they not receive further Promotional or marketing communications from the Promoter at any time by contacting the Promoter at sally@blackbirdpr.com.auor by electing to ‘opt out’ by using the ‘opt out’ function on any electronic marketing materials received.

The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988(as amended by the Privacy Amendment (Enhancing Privacy Protection) Act 2012), as well as any other applicable laws.
